In these Terms and Conditions “we, our, us, Soar Tackle refers to Soar Tackle
ACCEPTANCE OF TERMS
By accessing the content of www.soartackle.co.uk(“the Web site”) you agree to be bound by the terms and conditions set out herein and you accept our privacy & cookie policy. If you object to any of the terms and conditions set out in this agreement you should not use any of the Web site and leave immediately.
You agree that you shall not use the Web site for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the web site in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Web site. You also agree not to compromise the security of the Web site or attempt to gain access to secured areas or sensitive information.
You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.
1 MODIFICATION
Soar Tackle reserve the right to change any part of this agreement without notice and your use of the Web site will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement.
Soar Tackle has complete discretion to modify or remove any part of this site without warning or liability arising from such action.
2 LIMITATION OF LIABILITY
Soar Tackle will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Web site. Soar Tackle is fully insured which includes product liability and public liability.
3 COPYRIGHT
All trademarks, trade names, patents, registered designs and any other property rights derived from the esthetics or functionality of the Web site remain the property of their respective owners, and are used on this web site for reference only.
By using the Web site you agree to respect these property rights and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Web site.
4 DISCLAIMERS
The information contained with the Web site is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components, all images and wording are for illustration purposes only, items may have been updated and or superceded by the manufactor than that shown.
We do not guarantee uninterrupted availability of the Soar Tackle Web site and cannot provide any representation that using the Web site will be error free.
5 OUT OF STOCK ITEMS
Here at Soar Tackle our staff will try to avoid any disappointment on out of stock items, but on occasions where listed goods are out of stock, we may offer items of similar value or better specification and value to your original choice. If you want the item of choice that is out of stock we will back order this for you, unless advised otherwise. As soon as the purchase is in stock we will contact you to advise delivery.
We endeavour to ensure product availability wherever possible, all products and services are subject to availability and maybe withdrawn at anytime without prior notice.
Soar Tackle are not responsible for compensating you for any unforeseeable losses you may suffer in relation to goods ordered and if goods are not supplied, deemed faulty, damaged in transit or delayed.
Your statutory rights as a consumer are not affected.
6 FAULTY GOODS
Manufacturers Defect Found:
All products are covered by their relivent manufactures guarantee for up to 3 months against manufacturing defects from the date of purchase unless stated otherwise as per manufactures terms, this does not apply to faults caused by accident, neglect, misuse or wear and tear.
If you think there is a fault with your purchase please contact us so we can help you get the item back to us and look to sort any problems.
Any faulty goods must be returned to the shop with proof of purchase. Please note some items may have to be returned back to their place of manufacture for inspection by their own department, we will organise this for you.
If the the fault is declared a manufactures fault, the item will be replaced with the same or equal product. If the item is return by post a refund for return postage will be issued.
·The item(s) will be repaired, replaced or the value of returned item(s) may be refunded.
· If the item(s) are discontinued we will offer a replacement of equal or better specification or may be refunded.
A product refund may only be issued with in a suitable time scale of use / owning the item
The Soar Tackle reserves the right to have the goods inspected by a technician prior to replacement or refund.
A manufactures guarantee will not apply to any faults that are deemed to of been caused by accident, neglect, misuse or general wear and tear. This also extends to any modifications made to a product from its original as sold state. E.G the drilling and fitting of side puller bushes to pole sections and or cutting back of pole sections to allow fitment of larger bushes.
The Soar Tackle are not responsible for compensating you for any unforeseeable losses you may suffer in relation to faulty goods.
7 UNSUITABLE GOODS
You have the right to return an item or cancel your order with us, in accordance with Consumer Protection (Distance Selling) Regulations.
The period in which you have to exercise that right, by law is 14 calendar days from the date of receiving your goods. The unused goods, in their original packaging as sold including any offer/free item(s) received in conjunction with the returned item(s) must be returned, at the customer’s expense, with the relevant returns form filled out within 14 calendar days of you notifying us in writing or by email that you wish to return any unwanted goods. We will refund you in full the price of the goods once we are in receipt of the unwanted items and that they are found to be unused and in as new re-saleable condition. Soar Tackle reserves the right to make a deduction from any refund for any loss in the value of the goods supplied, if the loss is the result of unnecessary handling or neglect by the consumer (beyond what is necessary to establish the nature, characteristics and functioning of the goods). This means if the consumer has done something to diminish the value of the goods beyond what was necessary to reasonably inspect the goods, for example, the consumer has worn or used the goods, then Soar Tackle will be entitled to make a deduction from the refund if this has decreased the items value.
Any applicable refunds will be issued with in 14 calendar days of receipt and in inspection of the returned item(s)

7a SPECIAL ORDER AND MODIFIED GOODS
Items that are non stock items, items that are ordered in specifically and or modified in anyway E.G elastics fitted side pullers fitted at the request of the customer including non stock spare parts are non returnable or refundable unless faulty. Refer to clause 6.
8 Delivery
It is your responsibility to make sure you provide us with the correct contact and delivery address details. This includes a mobile phone number (preferable) as well as an email address. At each step a progress email will be provided by ourselves with the details provided by you, if you should notice a mistake in the details that you have provided you must notify us. If your item has been dispatched you must use the couriers portal as provided to adjust your details, if an ETA time has been provided you may not be able to change an address. We will not be held responsible for incorrect details provide.
Within the UK you can usually expect delivery of your order between 2 and 7 working days from the day we receive your order. Due to events outside of our control 24hr & Saturday delivery servces are not guaranted**. On dispatch of your parcel(s) we will email you any tracking details or inform you that the courier will email you your tracking details. It is your responsibility to make sure your contact and delivery address details that you have provided are correct as well as veiw updates on your delivery ETA's and that you will available to receive the item/s you have ordered. If you are unable to receive your parcel it is your responsiblity, to update your delivery details with in the couriers app or website. Safe place & collection point see 8a
If a missed signed for delivery is made the courier may leave a card with details of how to rearrange a new delivery date or to collect your goods from their nearest dept.
Couriers will make up to two attempts to deliver after the second attempt the parcel will be return to us. If this is the case then we reserve the right to charge for and redelivery costs and make a restocking deduction of 10% from any refund for restocking. No refund will be issued for initial carriage costs.
If you have not received your order after 14 days of receiving your dispatched email please contact us quoting your order number name and address plus any tracking details sent by either ourselves or the courier.
We can then make any enquiries to the where your parcel is.
Outside the UK please contact us if you have not received your order after 2 weeks, quoting your order number name and address.
In the unlikely event your order is damaged in transit please contact us by telephone immediately. See note 8b
You must make the courier aware that the parcel is damaged and sign that for your parcel is damaged and not in good condition. Please retain any damage report forms given to you by the courier.
8a Safe place Yodel, DHL, DX, Parcel force, Royal mail & Evri allow you to divert your items to a neighbour, collection point or leave in a safe place. To do this simply follow their instructions through either their tracking email or text message. Please note Soar Tackle will not request this for you.
Completing your order for home delivery you accept that 'you will be available at the delivery address to recieve the placed order'. If you request a safe place and or have left a note for the courier to leave your parcel somewhere or with a neighbour Then it is at your own risk*.
Not available we recommend that you use the courier or Royal mails official collection points. This can be a convinent way to receive your parcel if your not going to be at home on your alloted delivery day as many collection points are local and open late, It also means that you do not have to wait in for your delivery.
*Soar Tackle cannot be held responsible for any theft, loss or damage to your goods or parcel resulting from this arrangement. Goods will not be replaced, refunded or credited.
**Soar Tackle will not refund any postage charges unless they are recoverable by Soar Tackle
8b COURIER DAMAGE
All items that are sent out for home delivery are carefully inspected and date photographed showing the delivery receipt and address. Possible courier damage must be reported with in 48hr's of sign for.
8c FREE CARRIAGE
All free carriage or free postage offers will be sent out by our chosen courier service, Strictly non transferable or redeemable against another product or service. Free carriage/post is only available to UK mainland excluding Highlands, Islands & Northern Ireland. Out of schedule collection / delivery requests are not apart of Free postage and will incure an extra processing and delivery charge.
9 PERISHABLE GOODS
Due to baits being perishable goods we are unable to issue any refunds on them unless they are sent in error.
9a In house fresh baits
Please note that we can only send fresh bait if you accept full responsibility for the condition of the bait when it is delivered to you. Non of our in house fresh baits contain preservatives. This means that if the bait is allowed to get warm over several days, for example, if transit is delayed, it may be in an unusable state by the time it reaches you. How ever the chance of this happening is very small.
We are unable to send fresh bait under frozen or even refrigerated conditions. For delivery to the UK, we recommend you select 24hr delivery. This is not a guarantee service, the service being next day from day of dispatch - not necessarily from day of order. Std delivery usually take's 48hr and in most case's fresh baits are fine to be sent on this service. Delivery to Europe or elsewhere will take at least 2-3 days.
We can not guarantee transit conditions, and certainly if delivery is delayed We therefore advise you to time your order carefully, so that you can use the bait straight away.
Please note that due to the above factors we are unable to accept responsibility for the condition and usability of frozen bait and therefore, will not reimburse you, if you are unhappy with the condition of the bait on arrival. We will only reimburse you if the goods are sent in error.
10 RETURNS POLICY
If the item(s) are to be returned please contact our staff at Soar Tackle on 01509670436 or email us at returns@soartackle.co.uk As set out in the distance selling directive and including the above paragraphs 6 & 7 you the customer must notify the seller with in 14day's that they wish to return an item/s . Please ensure that the item/s are in original or secure packaging, where necessary please state any fault and or why your are returning your items. Please enclose proof of purchase i.e. Invoice/Receipt along with your full personal details.
If you are returning a faulty item, where possible an emailed photograph of the fault is of great help.
Please obtain a certificate of posting from your post office or courier when you send any item back to us, regretfully we cannot be held responsible for goods whilst in transit.
11 VOUCHERS
All vouchers have a minimum spend of £10 plus Postage & Packaging unless stated otherwise, Vouchers can not be used in conjunction with any other offer, discount or like wise.
12 Club tickets
All club tickets including E Day Tickets are strictly non refundable or transferable and are excluded from free carriage offers. Clubs tickets of all forms are not covered under the distance selling act.
13 THIRD PARTIES
The Web site may contain hyperlinks to web sites operated by other parties. We do not control such web sites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such web sites does not imply any endorsement of views, statements or information contained in such web sites.
14 SEVERANCE
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
15 GOVERNING LAW AND JURISDICTION
This Agreement will be governed by the laws of England and any user of the Web site hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

Soar Tackle agrees to supply and you agree to purchase goods subject to these terms and conditions, which shall supercede any terms and conditions on any purchase order or document that you submit to Soar Tackle.
These terms and conditions apply and take precedence over all others. All goods remain property of Soar Tackle until full payment has been received. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and each party agrees to submit to the exclusive jurisdiction of the courts of England and Wales.
Please note that we practise a policy of continual review and reserve the right to change the above terms and conditions at any time without notice.
